Walkway Closure

General information for applicants on proposed walkway closures and sales procedures.

We have the authority to sell walkways that have been officially closed to the adjoining landowners pursuant to Part 2 of the Local Government Act 1993.

If your property adjoins a walkway and you are interested in pursuing a closure of the walkway and purchase of the land, we have a process that is required to formally close a walkway, define any subsequent sale process that might stem from the formal closure and articulate the responsibility for all parties involved.

How do I go about having a walkway adjoining my property closed?

In order for us to consider the closure of a walkway you are required to write to us requesting the closure of the walkway and outlining the reasons why you are requesting to have it closed.

It should be noted that closure of any walkway is subject to formal Council approval.

Who can buy the walkway land?

Any owner adjoining a walkway has the opportunity to indicate their willingness if they wish to purchase a portion of the walkway land. All four adjoining owners must support the closure in order for it to proceed. At least one owner from either end of the walkway must indicate their willingness to purchase a portion of the walkway land.

In the event that there are easements within the walkway land, then only two adjoining owners are able to purchase the land (one from either end). All costs associated with the closure of a walkway are to be paid by the adjoining owners who have indicated a willingness to purchase the walkway land.

How long will the process take?

If approved the closure process can take anywhere up to two years to complete as a number of authorities and utilities are consulted throughout the process which can often cause delays.

How much will it cost?

The market value of the walkway land will be determined on an individual basis with an independent market valuation being undertaken during the closure process.
